      • To identify usage trends. We may process information about how you use our Services to better understand how they are being used so we can improve them.

      • To save or protect an individual’s vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

  • 3.

WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. As such, we may rely on the following legal bases to process your personal information:

      • Legitimate Interests. We may process your information when we believe it is reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights and freedoms. For example, we may process your personal information for some of the purposes described in order to:

      • Analyze how our Services are used so we can improve them to engage and retain users

      • Diagnose problems and/or prevent fraudulent activities

      • Legal Obligations. • Vital Interests. We may process your information where we believe it is necessary to protect your vital interests or the vital interests of a third party, such as situations involving potential threats to the safety of any person.

  • 4.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents (“third parties“) who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct.

The categories of third parties we may share personal information with are as follows:

      • Cloud Computing Services

      • Data Storage Service Providers

      • Government Entities

      • Performance Monitoring Tools

      • When we use Google Maps Platform APIs. We use Google Maps Platform APIs (e.g., Google Maps API) to display delivery routes on a map within the application. When the application communicates with Google Maps Platform APIs, the following information may be processed: the coordinates of the delivery destination point, IP address, and device information. The application does not transmit the driver’s own current location to Google. A full list of what we use information for can be found in this section and in the previous section titled “HOW DO WE PROCESS YOUR INFORMATION?” When a driver launches turn-by-turn navigation, the application opens an external navigation service, which determines the driver’s location independently under its own terms and privacy policies. Your use of Google Maps is subject to Google’s Terms of Service and Google’s Privacy Policy. You may revoke permissions relating to location at any time in your device settings or by contacting us at the contact details provided at the end of this document.

  • 5.

DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: The application is a native mobile app and does not use browser cookies.

The Movelix mobile application is a native mobile app and does not use browser cookies or web beacons. Certain third-party components integrated into the application, such as mapping and navigation services, may use their own technologies to store or access information on your device. Any technical identifiers we use serve to maintain the security and operation of the application, prevent crashes, and save your preferences.

These clauses require all recipients to protect all personal information that they process originating from the EEA or UK in accordance with European data protection laws and regulations. Our Standard Contractual Clauses can be provided upon request. In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

    CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can

activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

DATA RECEIVED FROM MOVELIX TMS AND CONTACT DATA OF RECIPIENTS

The Movelix mobile application operates in connection with the Movelix TMS system. Driver accounts are created and managed by the driver’s

employer or the transportation company operating Movelix TMS. Certain personal information, such as the driver’s name, login credentials, and phone number, is provided to us through the Movelix TMS system rather than directly by the driver. To enable drivers to complete deliveries, the application also receives and displays contact information of recipients or customers, such as phone numbers, transmitted from the Movelix TMS system. Drivers may use this information solely to contact the recipient regarding a specific delivery, for example by phone or messenger. We process this information on behalf of the company operating Movelix TMS, which acts as the data controller and is responsible for the lawful collection of recipients’ personal information and for informing those individuals about the processing of their personal data.

  • 13.

THIRD PARTY MAPPING AND NAVIGATION SERVICES

The application displays delivery routes on a map and enables navigation to delivery destinations. For this purpose, the application uses third-party mapping and navigation services, including Google Maps and other providers. When a driver starts navigation, the application transmits only the coordinates of the destination point (the delivery location) to the selected navigation service. The application does not transmit the driver’s own current location to these navigation services; each navigation service determines the driver’s location independently, under its own terms and privacy policies. Your use of third-party mapping and navigation services is subject to the respective terms and privacy policies of those providers, including, where applicable, Google’s Terms of Service and Google’s Privacy Policy.

  • 14.

If we make material changes to this Privacy Notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Notice frequently to be informed of how we are protecting your information.
